  2. A bank, financial institution, or electronic money issuer
  3. A payment processor or remittance provider

All third-party games, brands, trademarks, and services remain the property of their respective owners.

  3. “Including” means “including without limitation”
  4. Electronic acceptance constitutes legal consent

3. ACCEPTANCE, CONSENT & LEGAL CAPACITY


3.1 Binding Agreement

By accessing or using the Platform, you represent and warrant that:

Users must comply with:

6.2 Prohibited Activities

Users shall not:

  1. Engage in fraud, abuse, or deception
  2. Exploit pricing, promotions, or systems

6.3 Enforcement

Gamers Blitz reserves the right to:

  3. Report illegal conduct to authorities

7. DIGITAL GOODS & SERVICE CHARACTERISTICS


7.1 Nature of Digital Goods

Digital Goods are:

  1. Intangible
  2. Delivered electronically
  3. Non-returnable once delivered

Users acknowledge the irreversible nature of delivery.

7.2 Accuracy of Orders

Users are solely responsible for:

  1. Correct game ID, server, and details
  2. Ensuring compatibility and eligibility

Errors caused by User input do not entitle refunds.

8. PRICING, FEES & PLATFORM DISCRETION


8.1 Pricing Authority

8.2 Taxes & Fees

Users are responsible for:

  1. Applicable taxes

9.1 Promotional Discretion

Promotions:

  1. Are optional
  2. May be modified or withdrawn
  3. Are subject to additional rules

9.2 Abuse Prevention

Abuse may result in:

  1. Disqualification
  2. Account termination
  3. Forfeiture of benefits

10. INTELLECTUAL PROPERTY RIGHTS

All Platform content is protected by intellectual property laws.

Users receive a limited, revocable, non-exclusive license to use the Platform for personal, lawful purposes only.


11. USER-GENERATED CONTENT

Users grant Gamers Blitz a:

Worldwide, perpetual, royalty-free, sublicensable license to use submitted content.

Users warrant ownership and legality of content.


12. PLATFORM AVAILABILITY & MODIFICATIONS

Gamers Blitz may:

  1. Modify or discontinue Services
  2. Perform maintenance
  3. Restrict access temporarily or permanently

No service continuity is guaranteed.

13. DISCLAIMERS (CORE)

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE”.

Gamers Blitz DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

14. LIMITATION OF LIABILITY (CORE)

To the maximum extent permitted by law:

  1. No liability for indirect or consequential damages
  2. Total liability capped at USD $100 or fees paid in last 12 months

15. INDEMNIFICATION (CORE)

Users agree to indemnify Gamers Blitz from claims arising from:

  1. Platform misuse
  2. Violation of Terms
  3. User Content

16. SURVIVAL

Sections on liability, indemnity, IP, arbitration, and governing law survive termination.


PART 2 — PAYMENTS, DIGITAL GOODS, REFUNDS, CHARGEBACKS, FRAUD & FINTECH RISK CONTROLS

17. FINANCIAL SERVICES DISCLAIMER

17.1 Non-Financial Institution Status

Gamers Blitz Inc. is not:

  1. A bank
  2. A financial institution
  3. An electronic money issuer
  4. A remittance provider
  5. A payment processor

Gamers Blitz does not hold customer funds, issue stored value, or provide regulated financial services unless expressly stated in writing.

All payment processing services are provided by independent third-party payment service providers (“PSPs”).

17.2 Third-Party Payment Providers

Transactions on the Platform may be processed through:

  1. Credit and debit card networks

  4. Alternative payment methods supported by regional PSPs

Use of such services is subject to:

  1. Their respective terms and conditions

  3. Their compliance requirements

Gamers Blitz bears no responsibility for acts, omissions, failures, or errors of third-party PSPs.

18. PRICING STRUCTURE & COMMERCIAL TERMS

18.1 Pricing Authority

Gamers Blitz reserves the exclusive right to:

  1. Set, adjust, or withdraw prices at any time
  2. Apply dynamic or region-specific pricing
  3. Limit availability or quantities of Digital Goods

Prices displayed at checkout are final at the time of confirmation.

18.2 Currency & Conversion

Users acknowledge that:

  1. Prices may be displayed in local or foreign currencies
  2. Currency conversion is handled by PSPs or card networks
  3. Exchange rates and conversion fees are determined by third parties

Gamers Blitz is not responsible for conversion discrepancies or foreign exchange charges.

18.3 Taxes, Duties & Fees

Users are solely responsible for:

  1. Value-added tax (VAT)
  2. Sales tax
  3. Goods and services tax (GST)
  4. Digital service taxes
  5. Withholding taxes or similar charges

Where legally required, Gamers Blitz may collect and remit applicable taxes.

19. DIGITAL GOODS — LEGAL CHARACTERISTICS

19.1 Nature of Digital Goods

Users acknowledge and agree that:

  1. Digital Goods are intangible
  2. Delivery is electronic and instantaneous
  3. Delivery may be irreversible
  4. Digital Goods cannot be physically returned

19.2 Irreversibility of Delivery

Once Digital Goods are:

  1. Delivered
  2. Redeemed
  3. Credited
  4. Activated

the transaction is deemed fully executed.

This characteristic is fundamental to the Platform’s operation and pricing.

19.3 User Responsibility for Accuracy

Users are solely responsible for:

  1. Entering correct game IDs, usernames, servers, regions
  2. Verifying compatibility with third-party games
  3. Ensuring eligibility for the purchased Digital Goods

Errors caused by incorrect User input do not constitute delivery failure.

20. ORDER CONFIRMATION & TRANSACTION FINALITY

20.1 Transaction Confirmation

A Transaction is considered complete when:

  1. Payment is successfully authorized, AND
  2. Delivery is initiated or completed

Electronic records maintained by Gamers Blitz shall constitute conclusive proof of the Transaction.

20.2 Duplicate or Erroneous Orders

Users must review order details carefully.

Gamers Blitz is not obligated to reverse Transactions resulting from:

  1. Duplicate orders
  2. User mistakes
  3. Buyer’s remorse

21. REFUND POLICY — DIGITAL GOODS (STRICT)

21.1 General No-Refund Rule

21.3 Limited Exception — Verified Delivery Failure

A refund may be considered only if ALL of the following conditions are met:

Users may cancel subscriptions at any time:

  1. Cancellation prevents future charges
  2. Previously charged periods are non-refundable

23. CHARGEBACKS, PAYMENT DISPUTES & ABUSE

23.1 Chargeback Definition

A chargeback occurs when a User disputes a Transaction through:

  1. A bank
  2. A card issuer
  3. A PSP

23.2 Chargeback Consequences

Initiating a chargeback without first contacting support may result in:

  1. Immediate suspension of the Account
  2. Revocation of Digital Goods
  3. Permanent Account termination
  4. Blacklisting from future Services

23.3 Chargeback Fees & Recovery

Users agree that Gamers Blitz may:

  1. Recover chargeback fees
  2. Offset amounts against future credits
  3. Pursue legal recovery where appropriate

23.4 Fraudulent Disputes

Knowingly filing false or abusive disputes constitutes:

  1. Fraud
  2. A material breach of these Terms
  3. Grounds for civil and criminal referral

24. FRAUD PREVENTION & PLATFORM SECURITY

24.1 Fraud Detection Systems

Gamers Blitz employs automated and manual systems to detect:

  1. Suspicious transactions
  2. Account abuse
  3. Payment irregularities
  4. Multi-accounting and promotion abuse

24.2 Transaction Monitoring

Transactions may be:

  1. Delayed
  2. Flagged
  3. Reversed
  4. Blocked

for compliance, security, or risk reasons.

24.3 Account Verification

Gamers Blitz may require:

  1. Additional verification
  2. Identity confirmation
  3. Proof of payment ownership

Failure to comply may result in service denial.

25. AML, SANCTIONS & COMPLIANCE CONTROLS

25.1 Anti-Money Laundering (AML)

Abuse includes:

28.2 Failed Payments

Gamers Blitz Inc. recognizes that online gaming and digital commerce platforms must implement heightened protections for minors and children, particularly where digital goods, payments, and user accounts are involved.

This Part establishes:

  1. Mandatory age-gating
  2. Clear eligibility thresholds
  3. Verifiable parental consent requirements
  4. Strict payment prohibitions for minors
  5. Legal responsibility allocation to parents or guardians

30.2 Applicable Laws & Standards

This Part is drafted to comply with and align to:

  1. Philippines — Data Privacy Act of 2012 (RA 10173)
  2. United States — COPPA, FTC Act, state consumer protection laws

34. PARENTAL LIABILITY & ASSUMPTION OF RISK

34.2 Financial Liability

Users must comply with third-party publisher policies independently.

41. REGULATORY COOPERATION

Gamers Blitz may cooperate with:

to ensure child safety and legal compliance.

42. SURVIVAL & ENFORCEMENT

This Part survives:

  1. Account termination
  2. Withdrawal of consent
  3. Platform discontinuation

Enforcement may occur even after termination where legally permissible.


PART 4 — PRIVACY, DATA PROTECTION & INFORMATION SECURITY MASTER POLICY

43. PURPOSE, SCOPE & REGULATORY INTENT

43.1 Purpose

This Part governs how Gamers Blitz Inc. collects, uses, stores, shares, protects, and disposes of Personal Data in connection with the operation of the Platform.

Gamers Blitz recognizes that data protection is a fundamental right and a core operational responsibility, particularly where digital commerce, minors, and cross-border services are involved.

43.2 Scope

This Policy applies to:

  1. All Users globally
  2. All Personal Data processed through the Platform
  3. All systems, databases, and service providers acting on behalf of Gamers Blitz

This Part applies in addition to Parts 1–3 and prevails where privacy-related matters are concerned.

43.3 Applicable Laws & Frameworks

This Policy is designed to comply with, and be interpreted in accordance with:

Where this Annex conflicts with the Core Terms, this Annex prevails to the extent required by EU law.
